Technical screening criteria for remaining environmental objectives now published

On 21 November 2023, the Delegated Regulation (EU) 2023/2486 of 27 June 2023 (“Environmental Delegated Act”) and the Delegated Regulation (EU) 2023/2485 of 27 June 2023 amending the Climate Delegated Act (“Delegated Regulation (EU) 2023/2485”) were published in the Official Journal.
The Environmental Delegated Act introduces technical screening criteria for economic activities substantially contributing to one of the remaining four environmental objectives i.e., (i) sustainable use and protection of water and marine resources, (ii) transition to a circular economy, (iii) pollution prevention and control and (iv) protection and restoration of biodiversity and ecosystems in the Taxonomy Regulation. To ensure consistency, amendments for the Climate Delegated Act as well as Delegated Regulation (EU) 2021/2178 have also been introduced. The delegated acts and amendments are further touched upon in our previous Pulse update.
Next steps: The delegated acts will enter into force 20 days from the publication date, i.e. on 11 December 2023. They will apply from 1 January 2024, except two points in the Delegated Regulation (EU) 2023/2485, the application on which will be extended to 1 January 2025.
